Description

De concessie heeft tot doel met de Stad Brussel een concessieovereenkomst te sluiten voor de exploitatie van een kansspelinrichting van klasse I (casino), in de zin van artikel 29, lid 3, van de wet van 7 mei 1999. De concessiehouder zal belast zijn met de exploitatie van het casino. Daartoe moet hij een vergunning van klasse A verkrijgen, afgegeven door de Belgische Kansspelcommissie. De inschrijver moet dus ook voldoen aan de voorwaarden om een dergelijke vergunning te verkrijgen. De overeenkomst wordt gesloten onder de opschortende voorwaarde dat de concessiehouder een vergunning klasse A verkrijgt van de Kansspelcommissie (art. 18 van het KB van 26 juni 2002). De concessie wordt geëxploiteerd op de volgende locatie: In het multifunctionele complex, voorheen "GALERIES ANSPACH" genoemd, gelegen aan de Anspachlaan 30 tot 36 en gevormd door de Grétrystraat, de Kleerkopersstraat en de Bisschopstraat, voorheen gekadastreerd in sectie B, nummer 1472/G (48a 67ca), nummer 1600/P (3a 45 ca) en nummer 1600/S (115,75 m²), en volgens recent kadastraal uittreksel sectie B nummer 1472KP0000 voor een totale kadastrale oppervlakte van 52 are 54 centiare: De entiteit genaamd "Casino", kadastraal geregistreerd in sectie B, nummer 1472KP0122, bestaande uit de volgende oppervlakten: • Een oppervlakte van 11.530 m² bestemd voor casino-activiteiten; • Een oppervlakte van 950 m² die momenteel bestemd is voor het restaurant op de zevende verdieping; • Een oppervlakte van 1.885 m² in de kelder bestemd voor parkeerplaatsen en opslag. Dat komt neer op een totale oppervlakte van 14.365 m². Het multifunctionele complex dat vroeger "GALERIES ANSPACH" heette, is eigendom van de stad Brussel. De stad Brussel heeft echter een erfpachtrecht op dit complex toegekend aan de N.V. NOUVELLES GALERIES DU BOULEVARD ANSPACH (afgekort "NGBA"), die de erfpachter is. Om de lokalen te kunnen exploiteren, krijgt de concessiehouder een opstalrecht toegekend door de erfpachter. De voorwaarden en bepalingen met betrekking tot dit opstalrecht zijn uiteengezet in het ontwerp van opstalakte in bijlage 4 bij dit bestek, dat de concessiehouder zal moeten ondertekenen. De concessiehouder zal naast de exploitatie van het casino ook verantwoordelijk zijn voor de exploitatie van de verschillende horecadiensten die in de lokalen waar deze concessie betrekking op heeft, zijn gevestigd, alsook voor de organisatie van evenementen op de site.
