Відповідно підпункту 5 пункту 32 підрозділу 2 розділу XX Податкового кодексу України (в редакції, чинній на дату укладення договору) звільнено від оподаткування ПДВ операції з увезення та постачання на митній території України апаратури для передачі та приймання голосу, зображень та іншої інформації, включаючи апаратуру для комунікації в мережі дротового або бездротового зв’язку, апаратури прослуховування направленої дії, радіостанцій ультракороткохвильового і короткохвильового діапазону військового призначення, розвідувально-сигнальної апаратури, їх частин і приладдя, кінцевим отримувачем яких відповідно до сертифікатів кінцевого споживача або згідно з умовами договору визначено правоохоронні органи, Міністерство оборони України, ЗСУ й інші військові формування, що здійснюють боротьбу з тероризмом відповідно до закону та/або беруть участь у здійсненні заходів із забезпечення національної безпеки і оборони, відсічі і стримування збройної агресії російської федерації. Покупець гарантує, що кінцевим отримувачем Товару є військова частина 3052 Національної гвардії України, та здійснює боротьбу з тероризмом відповідно до закону та/або бере участь у здійсненні заходів із забезпечення національної безпеки і оборони, відсічі і стримування збройної агресії російської федерації. Таким чином операція щодо постачання Товару за Договором звільнена від оподаткування ПДВ відповідно підпункту 5 пункту 32 підрозділу 2 розділу XX Податкового кодексу України.
