1. Przedmiotem zamówienia jest dostawa jednego fabrycznie nowego serwera do Sądu Najwyższego. 2. Opis przedmiotu zamówienia - formularz produktowy (OPZ), stanowi Załącznik Nr 1 do SWZ. 3. Przedmiot zamówienia nie został podzielony na części. 4. O udzielenie zamówienia ubiegać się mogą Wykonawcy, którzy spełniają warunki dotyczące: 1) zdolności do występowania w obrocie gospodarczym: Zamawiający nie wyznacza warunku w tym zakresie, 2) uprawnień do prowadzenia określonej działalności gospodarczej lub zawodowej, o ile wynika to z odrębnych przepisów: Zamawiający nie wyznacza warunku w tym zakresie, 3) sytuacji ekonomicznej lub finansowej: Zamawiający nie wyznacza warunku w tym zakresie, 4) zdolności technicznej lub zawodowej: Zamawiający uzna powyższy warunek za spełniony, jeżeli Wykonawca wykaże, że w okresie ostatnich 3 lat liczonych wstecz od dnia, w którym upływa termin składania ofert, a jeżeli okres prowadzenia działalności jest krótszy - w tym okresie, należycie wykonał co najmniej 2 umowy (zamówienia) obejmujące swoim zakresem realizację dostawy serwera o wartości każdej umowy nie mniejszej niż 200 000,00 zł brutto. 5. W przypadku Wykonawców wspólnie ubiegających się o udzielenie zamówienia (konsorcjum, spółka cywilna), warunki udziału w Postępowaniu mogą zostać spełnione przez jednego Wykonawcę lub łącznie przez wszystkich Wykonawców wspólnie ubiegających się o udzielenie zamówienia. 6. Ocena spełniania warunków wymaganych od Wykonawców nastąpi wg formuły: „spełnia - nie spełnia”, na podstawie informacji zawartych w złożonych oświadczeniach i dokumentach. 7. Wykonawca zobowiązuje się do realizacji Przedmiotu Umowy, w terminie nie dłuższym niż 40 dni kalendarzowych od daty zawarcia Umowy, jednak nie później niż do dnia 10 grudnia 2026 r. 8. WADIUM: 1). Zamawiający wymaga wniesienia wadium na okres związania ofertą. Wadium utrzymuje nieprzerwanie do dnia upływu terminu związania ofertą, z wyjątkiem przypadków, o których mowa w art. 98 ust. 1 pkt 2 i 3 oraz ust. 2 Ustawy. 2). Wadium powinno być wniesione przed upływem terminu składania ofert. Oferta Wykonawcy, który nie wniesie wadium lub wniesie je w sposób nieprawidłowy, zostanie odrzucona. 3). Wadium ustala się w wysokości: 7 000,00 zł (słownie: siedem tysięcy złotych). 4). Wadium wnoszone w formie określonej w ust. 9 należy dołączyć do oferty. 5). Wadium może być wniesione w formach określonych w art. 97 ust. 7 Ustawy. 6). Wadium wnoszone w pieniądzu powinno być wpłacone przelewem na konto Zamawiającego: Sąd Najwyższy, 00-951 Warszawa, Plac Krasińskich 2/4/6 na rachunek: 10 1130 1017 0020 0800 5120 0003 w banku BGK Oddział w Warszawie z oznaczeniem: „Wadium w Postępowaniu KPP III.2611.4.2026”. 7). W przypadku wnoszenia wadium w pieniądzu środki powinny znaleźć się na rachunku bankowym Zamawiającego w terminie określonym dla wniesienia wadium. Za moment wniesienia wadium uznaje się moment uznania na rachunku Zamawiającego. Ze względu na ryzyko związane z czasem trwania okresu rozliczeń międzybankowych Zamawiający zaleca dokonanie przelewu ze stosownym wyprzedzeniem. 8). Wadium wnoszone w formie innej niż w pieniądzu musi w szczególności określać bezwarunkowy, nieodwołalny obowiązek zapłaty na pierwsze żądanie Zamawiającego w przypadkach określonych w art. 98 ust. 6 pkt 1-3 Ustawy oraz być ważne przez okres związania ofertą, określony w niniejszej SWZ. Wadium nie może mieć postanowień ograniczających obowiązek zapłaty wadium. 9). Wadium wniesione w formach określonych w art. 97 ust. 7 pkt 2-4 Ustawy należy wnieść za pośrednictwem Platformy zakupowej w formie elektronicznej - Zamawiający wymaga złożenia dokumentu wadium poprzez wczytanie na Platformie zakupowej oryginału dokumentu ustanawiającego wadium, tj. opatrzonego kwalifikowanym podpisem elektronicznym osób upoważnionych do jego wystawienia ze strony gwaranta/poręczyciela. Wadium powinno zostać przekazane Zamawiającemu w takiej formie, w jakiej zostało ono ustanowione przez gwaranta lub poręczyciela (w oryginale). 10). Wadium wniesione w formach określonych w art. 97 ust. 7 pkt 2 - 4 Ustawy, w przypadku Wykonawców wspólnie ubiegających się o udzielenie zamówienia, musi obejmować swą treścią wszystkich Wykonawców wspólnie ubiegających się o udzielenie zamówienia lub z treści wadium musi wynikać, że zabezpiecza ofertę Wykonawców wspólnie ubiegających się o udzielenie zamówienia (konsorcjum). 11). Dokument wadialny musi zawierać informację, iż stanowi zabezpieczenie wadium na rzecz Sądu Najwyższego, w przetargu nieograniczonym na ,,Dostawę serwera do Sądu Najwyższego". Postępowanie nr KPP III.2611.4.2026. 12). Wszelkie koszty związane z wniesieniem wadium ponosi Wykonawca. Przedmiotem zamówienia jest dostawa jednego fabrycznie nowego serwera do Sądu Najwyższego. Opis przedmiotu zamówienia - formularz produktowy (OPZ), stanowi Załącznik Nr 1 do SWZ.
