Description

De gemeente Leidschendam-Voorburg is voornemens een opdracht te gunnen aan KPN voor het treffen van tijdelijke overbruggingsmaatregelen in de netwerk- en securityomgeving. Deze maatregelen omvatten onder meer de vervanging van het externe firewallcluster, de tijdelijke verlenging van licenties en support voor netwerkcomponenten en de implementatie van een oplossing voor e-mailbeveiliging. De gemeente past voor deze gunning de onderhandelingsprocedure zonder voorafgaande aankondiging toe op grond van artikel 2.32 lid 1 van de Aanbestedingswet 2012, wegens dwingende spoed die niet aan de aanbestedende dienst is te wijten, in combinatie met technische en operationele afhankelijkheden binnen de bestaande ICT-omgeving. De betreffende systemen bereiken in 2026 hun End of Life / End of Support. Het gebruik van niet-ondersteunde systemen is niet verenigbaar met geldende wet- en regelgeving (BIO en NIS2) en brengt onaanvaardbare risico’s met zich mee voor de continuïteit en beveiliging van de gemeentelijke dienstverlening. Gelijktijdig loopt een aanbestedingstraject voor het structurele ICT-beheer, waardoor de benodigde maatregelen niet tijdig via een reguliere aanbestedingsprocedure kunnen worden gerealiseerd. KPN is als huidige leverancier en beheerpartij volledig bekend met de bestaande infrastructuur en configuraties. De gevraagde maatregelen sluiten direct aan op deze omgeving. Inschakeling van een andere partij zou leiden tot aanzienlijke implementatierisico’s, vertraging en hogere kosten, en daarmee tot een verhoogd risico voor de continuïteit en beveiliging van de dienstverlening. Op basis van deze omstandigheden is de gemeente van oordeel dat alleen KPN de opdracht kan uitvoeren zonder disproportionele risico’s. De opdracht heeft een tijdelijk en strikt noodzakelijk overbruggend karakter. Na publicatie van dit bericht wordt een wachttijd van tien kalenderdagen gehanteerd alvorens tot definitieve gunning wordt overgegaan.
