Description

Motivering toepassing onderhandelingsprocedure zonder voorafgaande aankondiging. De Universiteit Twente heeft besloten de opdracht voor de brokerdienstverlening te gunnen via de onderhandelingsprocedure zonder voorafgaande aankondiging op grond van artikel 2.32, eerste lid, onder c, Aanbestedingswet 2012. Aanleiding hiervoor is het onvoorzien wegvallen van de bestaande broker. De overeenkomst met deze broker is ontbonden na ingebrekestelling, wegens het niet-nakomen van contractuele verplichtingen. Hierdoor is de aanbestedende dienst per direct zonder essentiële brokerdienstverlening komen te zitten. De continuïteit van deze dienstverlening is noodzakelijk voor de uitvoering van de bedrijfsvoering en publieke taken. Het doorlopen van een reguliere aanbestedingsprocedure is, gelet op de benodigde termijnen, niet mogelijk zonder onaanvaardbare risico’s, waardoor sprake is van dwingende spoed. Deze situatie is het gevolg van een onvoorziene omstandigheid en is niet aan de aanbestedende dienst toe te rekenen. De onderhandelingsprocedure zonder voorafgaande aankondiging is uitsluitend toegepast als tijdelijke overbruggingsmaatregel. De looptijd van het contract is beperkt tot hetgeen strikt noodzakelijk is en loopt tot en met september 2026, in afwachting van de afronding van een nieuwe reguliere aanbestedingsprocedure.
