KD. Kizárólag új (soha nem használt) eszközök és kizárólag egyforma (azonos gyártmányú és típusú) eszközök ajánlhatóak. 3 év (36 hónap) teljes körű gyártói jótállás (helyszíni gyártói garancia) kötelezően biztosítandó. Ahol a közbeszerzés tárgyának egyértelmű és közérthető meghatározása szükségessé tesz meghatározott gyártmányú, eredetű, típusú dologra, eljárásra, tevékenységre, személyre, szabadalomra vagy védjegyre való hivatkozást, ott Ajánlatkérő a 321/2015. (X. 30.) Korm. rendelet 46. § (3) bekezdésében foglaltak szerint az azzal egyenértékű eszközök, berendezések, stb. megajánlását is elfogadja. Amennyiben a műszaki leírás meghatározott gyártmányú, eredetű, típusú dologra, eljárásra, tevékenységre, személyre, szabadalomra vagy védjegyre való hivatkozást tartalmaz, abban az esetben Ajánlatkérő minden esetben a „vagy azzal egyenértékű” terméket is ért. Az egyenértékűség bizonyítása az Ajánlattevő feladata. Az egyenértékűség igazolásához az Ajánlattevők számára a bizonyítékok minden formájának használata megengedett. A pontos mennyiségi és minőségi adatokat a Közbeszerzési Dokumentumok tartalmazzák.
