У разі надходження звернення від особи з інвалідністю, яка забезпечується виробами медичного призначення відповідно до постанови Кабінету Міністрів України від 03.12.2009 № 1301 «Про затвердження Порядку забезпечення осіб з інвалідністю, дітей з інвалідністю, інших окремих категорій населення медичними виробами та іншими засобами», про те, що поставлений товар їй не підходить з медичних, фізіологічних або інших обґрунтованих причин, Замовник має безумовне право на повернення Постачальнику товару, у разі поставки товару, відмінного від заявленого в закупівлі, з обов’язком Постачальника прийняти такий товар і повернути його вартість у повному обсязі.
