The buyer, the Lithuanian contracting authority, has rejected the final offer submitted by UAB 'Transporto aptarnavimo centras LT' in a negotiated procedure for the purchase of spare parts for a Kelmačio forage harvester. The offer was rejected because it failed to meet the requirement that a final offer must comply with all requirements, conditions and criteria set out in the procurement documents, including any requirements for alternative offers. The offer price was also higher than the supplier's initial offer, whereas under the special procurement conditions the price agreed during negotiations may only be reduced, not increased.
