Medicina di Laboratorio, con metodica in Turbidimetria su strumentazione dedicata (Optilite Instrument), per lo screening, la diagnosi, la prognosi ed il monitoraggio delle discrasie plasmacellulari, distribuiti in esclusiva sul territorio nazionale dalla Ditta Binding Site S.r.l., con sede legale in Grassobbio (BG) in via Zanica, 19K, Partita IVA 07097690965. Acquisto tramite Procedura negoziata senza previa pubblicazione I lavori, le forniture o i servizi possono essere forniti unicamente da un determinato operatore economico per una delle seguenti ragioni: la concorrenza è assente per motivi tecnici Spiegazione: Come affermato dalla giurisprudenza della Corte di Giustizia Europea (cfr. sentenza della C.Giust.UE 8 aprile 2008,causa c-337/05), confermata dal resto della giurisprudenza nazionale, la procedura negoziata senza previa pubblicazione del bando di gara riveste carattere di eccezionalità rispetto all'obbligo delle amministrazioni aggiudicatrici di individuare il proprio contraente attraverso il confronto concorrenziale, per cui la scelta di tale modalità richiede un particolare vigore nell'individuazione dei presupposti giustificativi, da intendersi restrittivamente, ed è onere dell'amministrazione committente dimostrarne l'effettiva esistenza. A tale scopo l'A.O.U.P. di Palermo, avviando una consultazione di mercato richiede il supporto dello stesso, al fine di acquisire certezza di quanto ritenuto alla luce delle sue attuali conoscenze. Solo a seguito dell'esperimento di suddetta consultazione e solo se quanto dichiarato circa l'infungibilità dei prodotti che ci occupano, troverà conferma, l'A.O.U.P. di Palermo, precederà all'aggiudicazione del contratto, utilizzando lo strumento della procedura negoziata senza previa pubblicazione di un bando
