Le marché porte sur la souscription des contrats d'assurances "flotte automobile" pour les besoins du groupement de commandes constitué entre la Ville du Touquet-Paris-Plage (coordonnateur), le CCAS, Le Touquet & Co et la Régie Aéroport International Le Touquet Elizabeth II (AILE II). La consultation a pour objet le choix : - du (ou des) intermédiaire(s) d'assurances (Agent Général ou Courtier) qui sera(ont) chargé(s) du placement des contrats, de leur gestion et du règlement des sinistres, - de la (ou des) société(s) d'assurances mutuelles ou à forme mutuelle sans intermédiaires qui couvrira(ont) les différents risques d’assurances de des membres du groupement de commandes. Le marché est composé d'un lot unique conclu pour une durée maximale de 3 ans avec une prise d'effet au 1er janvier 2027. Le contrat pourra être résilié au 31 décembre de chaque année moyennant un préavis de 6 mois pour le titulaire et 4 mois pour le pouvoir adjudicateur. Le marché porte sur la souscription de contrats d'assurance "flotte automobile" pour les besoins du groupement de commandes a été constitué entre la Ville du Touquet, le Centre Communal d’Action Sociale, la régie Touquet & CO et la régie de l’Aéroport International Le Touquet Elisabeth II (Aile II), en application des dispositions des articles L 2113-6 et suivants du Code de la commande publique. Le coordonnateur du groupement est la Ville du Touquet Paris-Plage. A ce titre, et en application de la convention de groupement de commandes, il incombe au coordonnateur de gérer et de mener à terme l’ensemble de la procédure de passation des marchés, de signer et notifier le marché au nom des membres du groupement et de conclure et de signer d'éventuels avenants et décisions de reconduction. Par ailleurs, il a été convenu que chaque membre exécute les marchés le concernant. Le lot unique est commun à l’ensemble des membres du groupement de commandes. Par suite, le candidat devra impérativement présenter une offre pour chacun des membres du groupement de commandes concerné que son offre puisse être regardée comme complète et régulière. Le lot sera attribué à un seul et même cocontractant. le marché ne comporte pas de variantes imposées et les variantes libres ne sont pas autorisées. Le marché pourra être attribué à un prestataire individuel (Société d'assurance) ou à un groupement d’entreprises. Ce groupement, constitué d'un (ou plusieurs) intermédiaire(s) (Agent Général ou Courtier) et/ou d’une (ou plusieurs) Société(s) d'assurances, devra être formé dès la remise des offres. Après attribution, il prendra obligatoirement la forme d'un groupement conjoint avec mandataire non solidaire. Cette forme de groupement est justifiée au regard du fait que dans le cadre des groupements solidaires, chaque cotitulaire est engagé financièrement pour le montant global du marché ou du lot et donc de l’ensemble du risque. En application des dispositions de l'article R 2151-7 du Code de la commande publique, il est interdit aux candidats de présenter une offre en agissant à la fois : En qualité de candidats individuels et de membres d'un ou plusieurs groupements ; En qualité de membres de plusieurs groupements. En application des dispositions des articles L. 310-1 et suivants et L. 511-1 et suivants du Code des assurances, les prestations sont réservées à des Sociétés d'assurances et/ou d'intermédiaires en assurances. Les personnes morales sont tenues d'indiquer les noms et les qualifications professionnelles des membres du personnel chargé de la prestation.
