Le marché porte sur les prestations relatives : • Aux études, aux développements des logiciels, au paramétrage complet ; • Aux essais usine, site, d’interopérabilité, intégration ; • A la production, contrôle qualité et la livraison des équipements ; • A la désinstallation complète de l’ancien système billettique (hors DAT) ; • A l’installation du matériel : en embarqué, au sol, en agence, aux dépositaires, etc ; • A la mise en service et à la garantie des équipements et du système ; • A l’hébergement et maintien en conditions opérationnelles de la solution ; • A la formation aux systèmes et outils ; • A la fourniture des consommables : supports, SAM, etc ; • A des prestations de maintenance logicielle et matérielle. Conformément aux dispositions des articles L.1212-1 et suivants du code de la commande publique, la Métropole du Grand Nancy, la Communauté de communes du Bassin de Pompey, et la Communauté de communes du Pays du Sel et Vermois interviennent en tant qu’entités adjudicatrices en leur qualité d’autorités organisatrices de la mobilité. Le Syndicat Mixte des Transports Suburbains de Nancy intervient en tant qu’entité adjudicatrice en sa qualité de syndicat mixte de transports défini à l’article L.1231-10 du code des transports et des compétences qu’il exerce au titre de l’article L1231-11 du même code pour l’organisation des services de mobilité suburbaine. La Métropole du Grand Nancy intervient comme coordonnateur du groupement de commande pris en application des dispositions des articles L.2113-6 et suivants du code de la commande publique dont les membres sont les suivants : Métropole du Grand Nancy, Communautés de communes du Bassin Pompey, Communautés de Communes du Pays du Sel et du Vermois et Syndicat Mixte des Transports Suburbains de Nancy. La Métropole du Grand Nancy sera seule chargée de la procédure de passation et de l’exécution de ses besoins propres et mutualisés avec les autres membres. Chaque membre du groupement a en charge l’exécution technique et financière des prestations (émission des bons de commande, règlement des prestations, etc.). Les caractéristiques sont précisées au Cahier des Clauses Techniques Particulières (CCTP). Le marché prévoit : • Une tranche ferme, • Une tranche optionnelle n°1 (TO1) portant sur des prestations de maintenance du matériel. Le contrat est conclu pour une durée de quatre seize (96) mois ferme (tranche ferme et tranche optionnelle) répartie ainsi : une tranche ferme d’une durée de 96 mois incluant la tranche optionnelle d’une durée de 48 mois. Il s’agit d’un contrat composite correspondant pour partie à un marché ordinaire et pour partie à un accord-cadre à bons de commande. La tranche ferme sera rémunérée à la fois par application de prix global et forfaitaire et par application aux quantités réellement exécutées des prix unitaires fixés dans le bordereau des prix. Pour la partie exécutée selon la technique d’achat de l’accord-cadre mono-attributaire, le montant maximum s’élève à 5 500 000 euros HT. Le présent marché fixe toutes les conditions d'exécution des prestations pour la partie à bons de commande. Il est exécuté au fur et à mesure de l'émission de bons de commande par chaque membre du groupement de commandes. Conformément aux dispositions de l’article L2112-2 du code de la commande publique, l’exécution du marché comporte une clause d’insertion par l’activité économique. Les modalités sont décrites au CCAP).
