Description

El presente contrato de servicio tiene la consideración legal de complementario del contrato de obra referido en su título, de conformidad con lo dispuesto en el artículo 29.7 de la LCSP. La necesidad de este contrato de servicio trae causa de la existencia del contrato de obra al que se refiere, teniendo el contrato de servicio una relación de dependencia respecto del contrato de obra y cuyo objeto se considera necesario para la adecuada realización de la prestación comprendida en el contrato de obra. El servicio objeto de este contrato accesorio al contrato principal de obra abarca los trabajos definidos al detalle en el pliego de prescripciones técnicas, entre los que se incluyen los necesarios relacionados con la liquidación del contrato de obra en los términos expresados en dicho pliego. Para el cumplimiento de los objetivos pretendidos con los trabajos y actividades incluidas en la prestación objeto de este contrato de servicio directamente vinculado al contrato de obra, se realizarán las tareas, entre otras previstas, de control cuantitativo (mediciones, topografía de detalle) y cualitativo (comprobación y verificación de equipos para su aprobación por la dirección facultativa de obra, vigilancia continua de ejecución a pie de obra), así como de apoyo y asistencia técnica, si fuese el caso, en el proceso de elaboración de documentos técnicos justificativos que resulten necesarios dentro del marco normativo (proyectos modificados, documentos técnicos a nivel “as built” y demás que correspondan).
