"El artículo 165 bis del Real Decreto 849/1986, de 11 de abril, por el que se aprueba el Reglamento del Dominio Público Hidráulico establece que el informe del Servicio previo a la propuesta de resolución de un procedimiento de extinción de una concesión hidroeléctrica deberá incluir una propuesta razonada sobre el futuro del aprovechamiento a extinguir, que incluya entre otros aspectos, recomendaciones sobre la continuidad de la explotación, la adscripción de la titularidad de las infraestructuras e instalaciones y sobre la gestión o en su caso demolición de las infraestructuras e instalaciones que deben revertir al Estado. Está prevista la aprobación de la guía para la utilización de herramientas de apoyo a la toma de decisión sobre el futuro del aprovechamiento basadas en indicadores técnicos, ambientales, económicos y sociales. Gracias a este trabajo, los Organismos de cuenca emplearán metodologías similares para el análisis de la viabilidad de explotación futura, consiguiendo reforzar y objetivar su informe correspondiente. La realización de un estudio técnico del detalle propuesto en la Guía requiere tiempo y el soporte de especialistas de diversos ámbitos (medio ambiente, energía, obra civil, patrimonio, derecho público, etc.) de los que la administración hidráulica no dispone, siendo conveniente la contratación de asistencias técnicas. "
