Учасник, незалежно від його форми оподаткування, під час подання тендерної пропозиції вносить в електронну систему закупівель інформацію про ціну пропозиції без урахування ПДВ. При укладанні договору про закупівлю з учасником, який зареєстрований в Україні як платник податку на додану вартість, а операція з постачання товару / надання послуг / виконання робіт підлягає оподаткуванню податком на додану вартість, сума ПДВ, розрахована згідно з вимогами законодавства України, буде нараховуватися на суму пропозиції переможця процедури закупівлі та зазначатися в договорі. При цьому сума договору з урахуванням ПДВ не може перевищувати суму, зазначену в річному плані закупівель, на підставі якого створено процедуру закупівлі. При укладанні договору про закупівлю з учасником, який не зареєстрований як платник податку на додану вартість в Україні або не є податковим резидентом України, сума договору зазначається без ПДВ.
