При закупівлі ДК 021-2015 (CPV) 65110000-7 - Розподіл води (послуги централізованого водопостачання), 65110000-7 - Розподіл води за ДК 021:2015 Єдиного закупівельного словника, застосовується переговорна процедура закупівлі, відповідно до діючих норм законодавства, а саме: Керуючись пп. 2 п. 13 Особливостей здійснення публічних закупівель товарів, робіт і послуг для замовників, передбачених Законом України «Про публічні закупівлі», на період дії правового режиму воєнного стану в Україні та протягом 90 днів з дня його припинення або скасування, що затверджений Постановою КМУ №1178 від 12.10.2022 р. а саме: … «відсутність конкуренції з технічних причин, яка повинна бути документально підтверджена замовником», що в свою чергу підтверджується наявністю підприємства надавача послуг централізованого водопостачання, КП «Тепловодсервіс» Миргородської міської ради, в зведеному переліку суб’єктів природніх монополій під номером 307, як єдиного надавача послуг з розподілу електричної енергії в регіоні замовника (МРЦ МВС України «Миргород»)
