Die Kommune ist im Rahmen ihrer hoheitlichen Aufgaben verpflichtet, in ihrem Gebiet eine ausreichende Beleuchtung der öffentlichen Wege und Flächen vorzunehmen (öffentliche Straßenbeleuchtung), die den gesetzlichen Anforderungen ihrer allgemeinen Verkehrssicherungspflicht genügt. Die Kommunen beabsichtigen zum Betrieb und zur Instandhaltung der Lichtpunkte der Kommune zur Beleuchtung von Straßen im Sinne des Straßengesetzes des Bundeslandes, dem die Kommune angehört (Öffentliche Verkehrsflächen), einen Wartungsvertrag abzuschließen.
