Der Landkreis Kelheim beabsichtigt als Aufgabenträger und zuständige Behörde nach Art. 8 Abs. 1 und 2 BayÖNVG i. V. m. § 8a PBefG und Art. 2 lit. c) VO (EG) Nr. 1370/2007, einen öffentlichen Dienstleistungsauftrag (ÖDA) über öffentliche Personenverkehrsdienste mit Kraftfahrzeugen nach § 2 Abs. 1 PBefG im Wettbewerb zu vergeben.Gegenstand des beabsichtigten ÖDA sind künftige öffentliche Personenverkehrsdienste auf der Freizeitbuslinie 6010 auf dem Gebiet des Landkreises Kelheim. Die zum Betriebsbeginn (01.05.2027) umfassten Verkehrsdienste sind im Ergänzenden Dokument (siehe Abschnitt VI) beschrieben.In Summe beläuft sich der zu vergebende Verkehrsdienst als sog. Saisonverkehr nach derzeitigem Planungsstand auf etwa 53 Tsd. Nutzkilometer pro Jahr, jeweils für die Zeit vom 01.05. bis zum 03.10. Der ÖDA bezieht sich hierbei auf Verkehrsdienste des öffentlichen Personennahverkehrs (ÖPNV) i. S. v. § 8 PBefG als Linienverkehr i. S. v. § 42 PBefG.Der Landkreis Kelheim kommt mit dieser Information seiner Veröffentlichungspflicht nach § 8a Abs. 2 PBefG i. V. m. Art. 7 Abs. 2 VO (EG) Nr. 1370/2007 nach.Diese Vorabbekanntmachung stellt zugleich eine Bekanntmachung gemäß § 135 Abs. 3 S. 1 Nr. 2 GWB dar.Gegen die geplante wettwerbliche Vergabe kann bis zur Erteilung des Zuschlags ein Nachprüfungsantrag bei der Vergabekammer Südbayern (Regierung von Oberbayern, Vergabekammer Südbayern, 80534 München, Tel.: +49 89 2176 2411, Fax.: +49 89 2176 2847) eingereicht werden.Der ÖDA kann nach Ablauf eines Jahres vergeben werden (Art. 7 Abs. 2 VO (EG) Nr. 1370/2007); damit wird zugleich die Frist des § 135 Abs. 3 S. 1 Nr. 3 GWB eingehalten.Für weitere Einzelheiten und hinsichtlich der Frist nach § 12 Abs. 6 Satz 1 PBefG wird auf die Ausführungen unter Abschnitt VI.1) verwiesen.(Art und Menge der Dienstleistungen oder Angabe von Bedürfnissen und Anforderungen)
