Die Auftraggeberin beabsichtigt, einen Vertrag zur Versorgung der Versicherten mit Hilfsmitteln der Produktgruppe 04 Bade- und Duschhilfen gemäß § 33 SGB V in Verbindung mit § 127 Absatz 1 abzuschließen. Bezüglich der Beschaffenheit der Produkte und Dienstleistungen wird auf das Hilfsmittelverzeichnis nach § 139 SGB V verwiesen. Ein Vertragsschluss begründet keinen Anspruch auf eine bestimmte Anzahl von Versorgungen oder einen bestimmten Auftragswert. Zentrale Elemente des Verfahrens: Mit dieser Vorinformation wird eine Vertragsabsicht gemäß § 127 Absatz 1 Satz 6 SGB V bekannt gemacht. Hiermit ist keine freiwillige Unterwerfung unter die Vorgaben des Vergaberechts verbunden. Eine weitere Bekanntmachung der Vertragsabsicht auf einem anderen Standardformular erfolgt nicht. Das Verfahren unterliegt nicht der Nachprüfung durch die Vergabekammern nach § 155 ff. GWB. Eine Begrenzung des Kreises von geeigneten Wirtschaftsteilnehmern, mit denen der Vertrag geschlossen wird, erfolgt nicht. Die Auftragsmenge für jeden Leistungserbringer kann nicht bestimmt werden, da sie sich auf eine unbestimmte Zahl an potenziellen Leistungsanbietern verteilt. Bei der angegebenen Verfahrensart handelt es sich nicht um ein Verhandlungsverfahren im Sinne des § 119 Absatz 5 GWB, da keine Auswahl der Verhandlungspartner stattfindet.
