Implementierung und Betrieb eines energiewirtschaftlichen ERP- und Abrechnungssystems als Software-as-a-Service-Lösung einschließlich der damit im Zusammenhang stehenden Pflege-, Support-, Schulungs- und Weiterentwicklungsleistungen sowie Leistungen bei Vertragsende. Die Kooperationsgesellschaft fränkischer Elektrizitätswerke mbH (im Folgenden: "kfe") schreibt hierzu eine Rahmenvereinbarung für Beschaffung eines Abrechnungs- und ERP-Systems als SaaS-Lösung aus. Die kfe ist Auftraggeber und Vertragspartner dieser Rahmenvereinbarung und schließt die Rahmenvereinbarung mit dem Auftragnehmer im eigenen Namen ab. Die in der Auftragsbekanntmachung aufgeführten Stadt- und Gemeindewerke (im Folgenden auch: "abrufberechtigte oder abrufende Werke") sind berechtigt, auf Grundlage dieser Rahmenvereinbarung die vertraglich festgelegten Leistungen durch Einzelabruf in Gestalt eines EVB-IT Cloudvertrages zu beauftragen. Gegenstand des Auftrags sind, nach Maßgabe des abzuschließenden EVB-IT Cloudvertrages vom Auftragnehmer gegenüber den abrufenden 17 Werken zu erbringende Leistungen, die mit den Vertragsunterlagen und -bestandteilen näher spezifiziert werden. Das neue System des Auftragnehmers muss für die abrufenden Werke so beschafft werden, dass einerseits die systemseitige Abbildung der Werke als eigenständige legale Einheiten erfolgt. Andererseits soll das System so beschaffen sein, dass eine möglichst gleichartige Gestaltung der Prozesse und Ausprägung des Systems über alle abrufenden Werke erfolgt.
