Die AG vergibt den Abschluss eines Rahmenvertrags über die Belieferung der AG und ihrer Tochtergesellschaften mit Diesel DIN EN 590 und Seehafendiesel. Die AG betreibt den Lübecker Hafen und hat für ihren Fuhrpark und Diesel-Loks einen durchschnittlichen jährlichen Bedarf von ca. 2 Millionen Litern Diesel. Diesen Bedarf hat die AG bisher durch die Beschaffung von jährlich ca. 50.000 Litern Diesel DIN EN 590 und im Übrigen durch die Beschaffung von Seehafendiesel gedeckt. Nach aktueller Rechtslage fällt die steuerliche Subventionierung (§ 3a Abs. 1 EnergieStG) für Seehafendiesel ab dem 01.07.2027 voraussichtlich weg und wird mit sehr hoher Wahrscheinlichkeit nicht über den 01.07.2027 hinaus verlängert. Die AG möchte daher grundsätzlich ihren gesamten Bedarf an Treibstoff in Höhe von zukünftig ca. 2 bis 2,5 Millionen Litern durch die Beschaffung von Diesel DIN EN 590 decken. Für den unwahrscheinlichen Fall, dass die steuerliche Subventionierung von Seehafendiesel auch nach dem 01.07.2027 fortbesteht, möchte die AG ihren Bedarf in Höhe von zukünftig jährlich ca. 2 bis 2,5 Millionen Litern, solange und soweit die Begünstigung besteht, auch künftig mit Seehafendiesel decken und lediglich ca. 50.000 Liter Diesel DIN EN 590 beziehen.
