Die Abfallwirtschafts- und Beschäftigungsbetriebe Landkreis Peine (nachfolgend: "Auftraggeberin") ist eine kommunale Anstalt des öffentlichen Rechts. Sie nimmt im Landkreis Peine die Aufgabe als öffentlich-rechtlicher Entsorgungsträger (§ 20 KrWG) wahr. Die Auftraggeberin schreibt in ihrer Funktion als öffentlich-rechtlicher Entsorgungsträger (§§ 17, 20 KrWG) die Beschaffung von Abfallsammelbehältern für die Sammlung von angefallenen und überlassenen Haushaltsabfällen im Gebiet des Landkreises Peine aus. Gegenstand der Vergabe ist die Lieferung von Abfallsammelbehältern mit losspezifisch unterschiedlichem Füllvolumen und zur Sammlung der im Hausmüll bekannten Abfallfraktionen Bio, Rest, PPK (Papier, Pappe, Kartonage). Bei den abzuschließenden Verträgen handelt es sich um eine Rahmenvereinbarungen gemäß § 21 VgV. Ansprüche auf Erbringung der Leistungen und Vergütung entstehen grundsätzlich ausschließlich nach einem in Textform (§ 126b BGB) erteilten Einzelabruf der Auftraggeberin. Ausgenommen von der Notwendigkeit des Einzelabrufes sind dabei die Mengen an Abfallsammelbehältern, die bereits mit Zuschlagserteilung beauftragt werden.
