Vadovaujantis Įstatymo 41 straipsnio 3 dalimi ir Pirkimo Bendrųjų sąlygų 1.12 punktu „Perkantysis subjektas bet kuriuo metu iki sutarties sudarymo turi teisę savo iniciatyva nutraukti pradėtas konkretaus pirkimo procedūras, jeigu atsirado aplinkybių, kurių nebuvo galima numatyti, ir privalo tai padaryti, jeigu buvo pažeisti Komunalinio sektoriaus pirkimų įstatymo 29 straipsnio 1 dalyje nustatyti principai ir atitinkamos padėties negalima ištaisyti“ II p.o.d. ir III p.o.d. nutraukti Pirkimą. Vadovaujantis Įstatymo 41 straipsnio 2 dalies 3 punktu laikyti Pirkimą II p.o.d. ir III p.o.d. pasibaigusiu. Vadovaujantis Įstatymo 2 straipsnio 6 dalies 2 punktu „Nepriimtinas pirkimo pasiūlymas - pasiūlymas, atitinkantis vieną ar kelis šių požymių: <...> 2) jame pasiūlyta kaina viršija pirkimui skirtas lėšas, perkančiojo subjekto nustatytas prieš pradedant pirkimo procedūrą <...>“ ir 64 straipsnio 10 dalimi „Perkantysis subjektas gali nevertinti viso tiekėjo pasiūlymo, jeigu patikrinęs jo dalį nustato, kad pasiūlymas vadovaujantis šio įstatymo reikalavimais turi būti atmetamas“, taip pat Pirkimo Bendrųjų sąlygų 14.7.5. punktu „<..> Laikoma, kad pasiūlyta kaina yra per didelė ir nepriimtina, jeigu ji viršija Perkančiojo subjekto pirkimui skirtas lėšas, nustatytas ir užfiksuotas Perkančiojo subjekto rengiamuose dokumentuose prieš pradedant pirkimo procedūrą. <..>“ atmesti JVS partnerių: UAB „CATERVA“ ir UAB „Energosistemos“, pasiūlymą dėl I p.o.d. ir IV p.o.d., nes šio tiekėjo pasiūlymo kaina I p.o.d. ir IV p.o.d. yra per didelė ir nepriimtina AB „Lietuvos geležinkeliai“. Vadovaujantis Įstatymo 41 straipsnio 2 dalies 2 punktu laikyti Pirkimą I p.o.d. ir IV p.o.d. pasibaigusiu.
