Закупівля здійснюється відповідно до рішення Черкаської селищної ради Самарівського району Дніпропетровської області від 29 червня 2026 року № 1154/60/VIII «Про внесення змін в Програму забезпечення заходів з підготовки територіальної оборони Черкаської селищної територіальної громади на 2025-2026 роки», у зв’язку з необхідністю закупівлі товарів для забезпечення потреб Збройних Сил України, органів військового управління, військових частин Сил територіальної оборони Збройних Сил України, інших суб’єктів територіальної оборони України, сил безпеки та сил оборони, які залучаються до виконання завдань територіальної оборони, на їх запит з подальшою безоплатною передачею таких товарів на облік запитувачів (кінцевих отримувачів). Відповідно до підпункту 5 пункту 32 підрозділу 2 розділу XX «Перехідні положення» Податкового кодексу України на період проведення антитерористичної операції та/або здійснення заходів із забезпечення національної безпеки і оборони, відсічі і стримування збройної агресії Російської Федерації, та/або запровадження воєнного стану відповідно до законодавства, звільняються від оподаткування податком на додану вартість операції з ввезення на митну територію України та постачання на митній території України товарів, кінцевим отримувачем яких відповідно до сертифіката кінцевого споживача або згідно з умовами договору визначено правоохоронні органи, Міністерство оборони України, Збройні Сили України та інші військові формування, добровольчі формування територіальних громад, утворені відповідно до законів України, інші суб’єкти, що здійснюють боротьбу з тероризмом відповідно до закону та/або беруть участь у здійсненні заходів із забезпечення національної безпеки і оборони, відсічі і стримування збройної агресії Російської Федерації проти України, підприємства, які є виконавцями (співвиконавцями) державних контрактів (договорів) з оборонних закупівель.
