На умовах Договору Постачальник зобов'язується поставити і передати у власність Покупцю Товар - Овочі, фрукти та горіхи (Огірки свіжі, польові, короткоплідні (до 14см), ДСТУ 3247м) згідно Специфікації, викладеної в Додатку №1 до Договору (далі -Специфікація), а Покупець зобов'язується їх прийняти, оплатити в строки та на умовах, передбачених Договором. Постачальник гарантує, що Товар, який є предметом Договору належить йому на праві власності або іншому речовому праві, що надає йому право розпоряджатися Товаром, є новим і не був у використанні, не перебуває під забороною відчуження, арештом, не є предметом застави та іншим засобом забезпечення виконання зобов’язань перед будь-якими фізичними або юридичними особами, державними органами і державою, а також не є предметом будь-якого іншого обтяження чи обмеження, передбаченого чинним законодавством України. Постачальник підтверджує, що укладання та виконання ним цього Договору не суперечить нормам чинного законодавства України та відповідає його вимогам (зокрема, щодо отримання всіх необхідних дозволів та погоджень), а також підтверджує те, що укладання та виконання ним цього Договору не суперечить положенням його установчих документів. Сторони підтверджують, що їм зрозуміла термінологія, що використовується в даному Договорі та що укладення цього Договору відповідає дійсній волі Сторін. Постачальник підтверджує, що країною-походження товару не є Російська Федерація/Республіка Білорусь/Ісламська Республіка Іран. Покупець здійснює 100% післяплату поставленого Товару протягом 10 (десяти) календарних днів з дати отримання Товару. Датою отримання Товару є дата зазначена в накладній
