Закупівля здійснюється відповідно до Закону України «Про публічні закупівлі», Особливостей, затверджених постановою КМУ від 12.10.2022 № 1178 (зі змінами та доповненнями), та Закону України «Про оборонні закупівлі». Технічні, якісні та кількісні характеристики предмета закупівлі детально визначені в Додатку № 2 до тендерної документації. Усі посилання в технічному завданні на конкретну торговельну марку, модель, виробника, серію (зокрема КФС.000.00.00-ЕНЕРГІЯ, серія AKFS-S-9) слід читати з виразом «або еквівалент». Учасники мають право пропонувати еквівалент товару, що повністю відповідає або перевершує задекларовані технічні характеристики. У вартість пропозиції Учасника обов'язково мають бути включені витрати на доставку, розвантаження, монтаж, підключення, пусконалагоджувальні роботи обладнання за адресою Замовника, а також інструктаж персоналу. До Учасників закупівлі встановлюються кваліфікаційні критерії та вимоги щодо наявності матеріально-технічної бази (виробничих потужностей), фінансової спроможності, а також обов'язкового надання відповідних сертифікатів (відповідності, якості, ISO тощо). Повний перелік цих вимог, склад та форми документів, які повинен надати Учасник у складі своєї пропозиції для підтвердження кваліфікації, зазначені в окремому Доповненні № 1 до тендерної документації. Фінансування закупівлі здійснюється за рахунок коштів Державного бюджету України. Розрахунки проводяться через органи Державної казначейської служби України по факту поставки товару.
