Відповідно до п. 3.2. ст. 3, пп. 136.1.15, 136.1 ст. 136, п. 197.11 ст. 197 Податкового кодексу України, Постанови Кабінету Міністрів України від 4 серпня 2000 р. №1222 «Про затвердження Порядку отримання благодійних (добровільних) внесків і пожертв від юридичних та фізичних осіб бюджетними установами і закладами освіти, охорони здоров’я, соціального захисту, культури, науки, спорту та фізичного виховання для потреб їх фінансування», Закону України «Про публічні закупівлі» предмет закупівлі не є об’єктом оподаткування. Згідно ст. 3 Рамкової Угоди між Урядом України та Комісією Європейських співтовариств від 12.12.2006 року (ратифікована із заявою Української сторони Законом України від 03.09.2008 року №360-VI) «Заходи, що фінансуються в цілому або частково коштом Співтовариства, не обкладаються податками, митними зборами, або іншими стягненнями аналогічного характеру».
