Description

Constitueix l'objecte del contracte l'alienació mitjançant subhasta pública de “l’estalvi energètic estimat” per un total de 1.525,511 MWh/any generats o obtinguts per les actuacions d’eficiència energètica ja realitzades per part de l’AMB segons consten a la present clàusula i es detallen al Plec de prescripcions tècniques. Els estalvis d’energia generats doncs, amb les actuacions d’eficiència energètica esmentades seran cedits a l’adjudicatari, subjecte obligat o delegat, a canvi d’una contraprestació econòmica aplicable a tots ells, amb independència de l’actuació de què es tracti, i amb el ple efecte translatiu inherent a la compravenda. Als efectes del procediment d'acreditació davant l'autoritat competent, les parts signaran el conveni CAE previst al RD 36/2023, de 24 de gener, pel que s’estableix un sistema de Certificats d’Estalvi Energètic (CAE), que opera com a instrument administratiu d'acreditació del negoci translatiu. Els esmentats estalvis estan catalogats a l’Inventari de l’AMB com a béns patrimonials de naturalesa incorporal, d’acord amb l’article 7.2 de la Llei 33/2003, de 3 de novembre, de Patrimoni de les Administracions Públiques (en endavant LPAP), no afectats a l’ús general o servei públic, i es troben lliures de càrregues.
