Norway - Training services - Intention notice - Amendment to the contract for management development and competence raising.

Sandnes municipality (hereafter called the contracting authority) would like to enter into an agreement for an additional delivery for the contract the contracting authority has with ValuEd and Kristiania University College for the delivery of management development and competence raising to managers in the school-free time scheme. The original contract for management development and competence raising was signed on the basis of an intention notice. A market survey was carried out and concluded that there were no other tenderers who could provide the same type of management development and competence raising. This was because the development and training was built on a framework plan developed by the Directorate of Education, including the possibility to take the exams by 30 credits, and contained workshops built on the leading by learning concept developed by Viviane Robinson. The contracting authority received only responses from ValuEd and Kristiania University College on the market survey and did not receive any complaints about the intention notice. The agreement was therefore signed, and the only remaining workshops are. The desired change to the agreement will mean that managers from primary and secondary schools will be able to participate in one of the last two workshops, with the aim that the Contracting Authority's school managers will benefit from synergy effects based on previously delivered management development and competence raising. The contracting authority ́s original contract included competence raising for managers within SFO. The additional delivery will in this case be that more people will participate in the competence raising ́s last workshop, and will thus lead to an increase in the contract ́s extent and price. The service provided must be compatible with the service that has so far been provided as part of the original contract. The contracting authority does not know that there are other suppliers who deliver a similar competence raising scheme that has been developed in accordance with the leading by learning management training concept. Neither are there other suppliers who can deliver this in connection with the competence raising that has already been provided to the contracting authority without considerable difficulties and extra costs. If the contracting authority switched to another tenderer for the additional delivery, it would require that the tenderer get into previously delivered competence raising and methodology in order to deliver the same synergy effect that the contracting authority will get from such a delivery from ValuEd. This would also require that the tenderer get into the same problems, discussions and solutions that were prepared during the months that the competence increase has been going on. Implementing such a thing would therefore require considerable resources both from the new tenderer and from the contracting authority, and would also most probably also result in a significant extra cost both internally and against the tenderer. The additional delivery that the contracting authority requests has a total value of NOK 600,000 excluding VAT. The contract value of the original contract was excluding VAT. 1 500 000. The additional delivery will therefore make up 40% of the original contract value. Based on the additional delivery being compatible with previously delivered competence raising and methodology, the contracting authority has demonstrated that it will cause considerable difficulties to procure this from another supplier. At the same time, the contracting authority has pointed out that the value is below 50% of the original contract ́s total value, nor does it know that there are other suppliers on the market as of now who can deliver a competence raising built on the same guiding training concept. Based on the above, the contracting authority therefore concludes that the change of contract is allowed under the procurement regulations §28-1 (1) c). The contracting authority would like to point out that in this notice it has had to state two tender offers in order to have both tenderers connected to the notice. The contracting authority has added NOK due to the value having to be given for both of the tenders. NOK 600,000 excluding VAT for each tender, but would like to point out that the change has a total value of NOK 600,000 excluding VAT, and that the tender notice does not have two alterations.
