Ukraine has received financing from: the International Bank for Reconstruction and Development (hereinafter - the "Bank") to cover the cost of the Health Enhancement and Lifesaving (HEAL) Ukraine Project financed under the Loan Agreement between Ukraine and the International Bank for Reconstruction and Development (hereinafter - the "Bank") dated December 22, 2022 No. 9468-UA (hereinafter - the "Loan Agreement") and the Council of Europe Development Bank (hereinafter - the "CEB") under the Framework Loan Agreement for the Implementation of the Health Enhancement and Lifesaving (HEAL) Ukraine Project dated June 11, 2024 No. LD 2167 and intends to use part of the funds for payments under the contract that is the subject of this procurement. 2. The Ministry of Health of Ukraine (hereinafter - the “Employer”) now invites Quotations from eligible Contractors for: Reconstruction of a Non-Residential Building (Letter B) with an Extension and Landscaping of the Adjacent Area into a Rehabilitation Center at the address: Gryboyedova St., 20 B, Uzhhorod The procurement is made within one lot and provides for the conclusion of one contract based on the results of the tender process. Works shall be made withing period of 14 months from the date of the Contract signing. The prospective Contractors shall meet the following Qualification Criteria: Historical Contract Non-Performance: Non-performance of a contract did not occur as a result of contractor default since 1st January 2020; Not under suspension based on execution of a Quotation Securing Declaration; All pending litigation, in aggregate, must not exceed thirty percent (30%) of the Contractor's net worth and shall be considered as resolved against the Contractor; No consistent history of court/arbitral award decisions against the Contractor since 1st January 2020; Declare any civil work contracts that have been suspended or terminated and/or performance security called by an employer for reasons of breach of environmental or social (including Sexual Exploitation and Abuse)) contractual obligations in the past five years since 1st January 2020; At the time of Contract Award, not subject to disqualification by the Bank for non-compliance with SEA/ SH obligations; If the Contractor had been subject to disqualification by the Bank for non-compliance with SEA/ SH obligations, the Contractor shall either (i) provide evidence of an arbitral award on the disqualification made in its favour; or (ii) demonstrate that it has adequate capacity and commitment to comply with SEA/SH prevention and response obligations; or (iii) provide evidence that it has already demonstrated such capacity and commitment on another Bank financed works contract. Financial Capabilities: (i) The Contractor shall demonstrate that it has access to, or has available, liquid assets, unencumbered real assets, lines of credit, and other financial means (independent of any contractual advance payment) sufficient to meet the construction cash flow requirements for three (3) months under this contract estimated as UAH 95 million , or an equivalent amount in foreign currency at the exchange rate of the National Bank of Ukraine (www.bank.gov.ua) 7 days prior to the deadline for submission of the Quotation. (ii) The Contractor s shall also demonstrate, to the satisfaction of the Employer, that it has adequate sources of finance to meet the cash flow requirements on works currently in progress and for future contract commitments. (iii) Financial information shall be provided for the last five (5) fiscal years: 2020 to 2024 inclusive . The submitted annual financial statements for the required period should demonstrate the stability of the Participant’s financial position, showing long-term profitability. Permanent losses or risk of insolvency reflected in the financial statements, or declared bankruptcy proceedings may be grounds for the Participant’s disqualification. (iv) The Employer may reject the Quotation if the amount of confirmed obligations that will be performed in parallel with the Contract exceeds the Contractor's annual turnover for the previous (2024) year by 1.5 (one point five-tenths) times. The Contractor’s minimum average annual turnover for completed construction work should be UAH 450 million , calculated as the total amount of confirmed payments received under contracts for construction work in progress and/or completed during the last 5 (five) years, starting from January 1, 2020 to December 31, 2024, d
